The terms governing the use of our route optimization platform.

1. Acceptance of Terms

By accessing the websites tesser.is, tesseris.app or app.tesser.is and using the Tesseris service, you agree to be bound by these Terms of Service. If you do not accept these terms, please do not use our service.

2. Service Description and Legal Information

Tesseris is a SaaS route optimization solution for service companies, published by Sohmware SARL with a capital of 5000 euros, SIREN 749862322, NAF 62.02A (3 rue Hanau, 67350 Niedermodern, France). Our platform uses artificial intelligence to optimize appointment scheduling and reduce technician travel time. The service includes: automated calendar consultation, AI-assisted appointment booking, route optimization via external geolocation APIs, SMS reminder sending and tracking features. Hosting: OVH SAS, 2 rue Kellermann, 59100 Roubaix, France.

3. User Account and Security

To use Tesseris, you must create an account with accurate and complete information. You are fully responsible for the confidentiality of your login credentials and all activity performed under your account. You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use and GDPR Responsibilities

You agree to use Tesseris only for legitimate professional purposes and in accordance with applicable laws. It is prohibited to use the service for illegal activities, attempt to disrupt service operation, or transmit malicious data. You must not exceed your plan's usage limits. It is strictly prohibited to: (a) Automatically access the service via scripts, bots or scraping techniques, except with prior written agreement; (b) Attempt to reverse engineer the internal functioning of the optimization algorithm, particularly through systematic observation of inputs/outputs; (c) Exploit or extract data massively for competitive or commercial purposes without authorization; (d) Use the service to design a competing product or service. Any breach of these prohibitions may result in immediate account suspension, filing of complaints and claim for damages. IMPORTANT: As a user company, you remain the data controller for your end customers' data and must comply with your GDPR obligations: information, consent, respect for rights. Tesseris acts only as a processor for this data.

5. Pricing and Payment

Subscription prices and additional services (SMS packs, additional features) are indicated in euros excluding VAT on our website. Payment is made monthly or annually by credit card, SEPA transfer or direct debit. Additional services are invoiced and payable under the same terms. SMS INCLUDED IN PLANS: SMS included monthly in Premium (50 SMS) and AI Optimization (200 SMS) plans are reset to zero each month and are not carried over from one month to another. These SMS constitute a service included in the subscription and are lost if not used in the billing month. ADDITIONAL SMS AND SMS PACKS: Additional SMS beyond the monthly quota and SMS packs constitute additional services billed separately. Unlike included SMS, SMS packs purchased separately have a validity period of 24 months from their purchase and are not reset monthly. In case of non-payment, we reserve the right to suspend your service access immediately. Incurred fees are not refundable except in case of major malfunction of our service.

6. Termination and Data Deletion

You may terminate your subscription at any time from your customer area or by contacting us. Termination takes effect at the end of the current billing period. We may suspend or terminate your account in case of violation of these terms, with 30 days notice except in case of serious violation. After termination, end customer data (appointments, contacts) is automatically deleted within 30 days. However, technical backups may be kept for a maximum period of 90 days for security and service continuity purposes. These backups are only accessible in case of major technical incident or justified legal request. You may request immediate deletion of all your data by contacting us at contact@tesser.is.

7. Limitation of Liability and Service Guarantees

Tesseris undertakes to provide the service with diligence but does not guarantee uninterrupted operation. In case of total unavailability of our servers occurring during our business hours (9am-6pm, Monday-Friday) and continuing beyond 12 consecutive hours, we grant a credit of 3% of the monthly subscription cost per full hour of unavailability beyond the first 12 hours, capped at 100% of said monthly cost. The customer must report the incident during our business hours to trigger credit attribution. For free accounts, credit is limited to €10 and granted only after 168h (7 days) of consecutive unavailability. Only total blocking malfunctions attributable to our infrastructure are covered: unavailability of our servers, databases, or essential services making the service totally unusable. Expressly excluded are: user authentication problems (forgotten password, account blocked by user), software bugs not preventing main use, API malfunctions, slowdowns, client configuration errors, user setup problems, partial feature malfunctions, client internet connection, unavailability or access rights problems to third-party integrations (Microsoft/Google calendars, and any other future extension), suspension or termination of our access to third-party services by these providers (Google, Microsoft, etc.), changes to third-party API access conditions, force majeure cases. Consumed SMS packs and communication credits cannot be refunded. However, in case of definitive and general suspension of our access to major third-party services (Google, Microsoft) making our service permanently unusable, we will proceed with pro rata refund of the unused subscription period. Temporary interruptions, user authorization or access token problems, or temporary technical malfunctions do not give rise to refund, as the time needed for corrections is considered reasonable. IMPORTANT: Our service interacts with external calendars (Google, Microsoft, etc.) that do not have easily accessible user backup features. Although we take all necessary technical precautions (detailed logs, monitoring systems, security procedures) to preserve your data integrity, we cannot guarantee the total absence of risk when interacting with these third-party systems. By using our service, you accept this risk inherent to integration with external calendars. In case of unwanted modification or data loss in your external calendars, our liability is limited to the credits provided in these terms, as these systems are outside our direct control. We cannot be held responsible for indirect damages, data loss, loss of profits or business interruptions.

8. Intellectual Property

Sohmware SARL is the exclusive owner of all intellectual property rights on the Tesseris service, including notably: software, optimization algorithms, user interface, design, trademarks, logos and all documentation. We grant you a license to use the service that is non-exclusive, non-assignable, non-transferable and strictly limited to the duration of your subscription. This license authorizes you only to use the service in accordance with these terms. You may not under any circumstances: copy, modify, distribute, sell, rent or sublicense all or part of the service, reverse engineer, decompile or disassemble the software, use the service to develop a competing product. You remain the owner of data you import into the service (information about your technicians, customers, appointments, etc.). Upon termination of your subscription, your license to use ends immediately.

9. Maintenance and Service Interruptions

We reserve the right to temporarily interrupt the service for planned maintenance operations necessary for its proper functioning, security or addition of new features. We strive to: notify these interruptions at least 48h in advance by email and/or notification in the application, schedule these maintenances during low traffic periods (generally between 11pm and 6am, French time), limit the duration of interruptions to what is strictly necessary. Emergency maintenance (security, critical bug fixes) may be performed without notice. These planned interruptions do not give rise to compensation unless they exceed 4h cumulative in a calendar month.

10. Applicable Law and Modifications

These terms are governed by French law. In case of dispute, we favor amicable resolution. Failing that, the courts of Strasbourg will have sole jurisdiction. We reserve the right to modify these terms at any time. Important modifications will be notified to you by email 30 days before they take effect. Your continued use of the service after this period constitutes your acceptance of the new terms. Minor modifications (corrections, clarifications) take effect immediately.
